Please read these Terms of Use ("Terms") carefully before using the WellNourished app and website at wellnourished.co (the "Service"), operated by WellNourished.co and AKB Fitness | Wellness ("we," "us," or "our"). By creating an account or using our Service, you agree to be bound by these Terms. If you do not agree, do not use our Service.
You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
IMPORTANT: WellNourished provides general nutrition information and personalized macro calculations for educational and informational purposes only. The content generated by our Service — including macro targets, meal plans, recipes, and AI-generated suggestions — does not constitute medical advice, dietary advice, or professional nutrition counseling.
You should consult a qualified healthcare provider, registered dietitian, or physician before making significant changes to your diet or exercise routine, particularly if you have or suspect you have a medical condition, eating disorder, or specific dietary needs. We are not liable for any health outcomes resulting from your use of information provided by the Service.
To access most features of the Service, you must create an account. You agree to provide accurate, complete, and current information during registration and to keep your account information up to date.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@wellnourished.co if you suspect unauthorized access. We are not liable for losses resulting from unauthorized use of your account.
Each account is for a single individual user. You may not share your account with others or create multiple accounts for the same person.
WellNourished offers the following subscription tiers:
Paid subscriptions are billed through Memberstack and processed by Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis at the applicable subscription rate. All prices are in USD.
Founding member pricing, where offered, is locked in for the life of your continuous subscription. If you cancel and resubscribe, founding member pricing may no longer apply.
You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods except where required by applicable law.
If we offer a free trial, it will be described at the time of sign-up. At the end of the trial, your account will automatically convert to a paid subscription unless you cancel before the trial ends.
You agree to use the Service only for lawful purposes. You agree not to:
All content on the Service — including text, graphics, logos, recipe content, UI design, software code, and the WellNourished name and brand — is owned by or licensed to AKB Fitness | Wellness and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our express written permission.
You retain ownership of any content you submit to the Service, including meal log entries and coaching application information. By submitting content, you grant us a limited license to use, store, and display that content solely for the purpose of providing the Service to you.
Recipes generated by our AI features are produced using the Anthropic Claude API based on your personal macro targets. These recipes are provided for your personal use only. You may not reproduce or distribute AI-generated recipes for commercial purposes.
The Service integrates with third-party services including Memberstack (account management), Stripe (payments), Anthropic (AI features), and Cloudflare (infrastructure). Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WELLNOURISHED, AKB FITNESS | WELLNESS, OR THEIR OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF REVENUE, OR HEALTH-RELATED OUTCOMES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless WellNourished, AKB Fitness | Wellness, and their officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another person or entity.
We reserve the right to modify, suspend, or discontinue the Service or any features at any time without notice. We also reserve the right to update these Terms at any time. When we make material changes, we will notify you via email or a prominent notice in the app. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
We may suspend or terminate your account at our discretion if you violate these Terms or engage in conduct that we determine is harmful to other users or to the Service. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.
These Terms are governed by the laws of the United States and the state in which AKB Fitness | Wellness is headquartered, without regard to conflict of law principles. Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property violations.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and WellNourished regarding your use of the Service and supersede all prior agreements or understandings. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
